1. Acceptance of Terms

Welcome to our Platform ("the App," "the Platform," "we," "our," or "us").

These Nutritionist Terms & Conditions govern your access to and use of the Nutritionist Account and all related Services provided through the Platform.

By creating, accessing, or using a Nutritionist Account, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions, together with our Privacy Policy, Health Disclaimer, Community Guidelines, and any additional policies that may apply.

If you do not agree with these Terms, you must not create or use a Nutritionist Account.

We reserve the right to modify or update these Terms at any time. Continued use of the Platform after any changes become effective constitutes your acceptance of the updated Terms.

2. Eligibility

To register and operate a Nutritionist Account, you represent and warrant that:

• You have the legal authority to provide nutrition-related services in accordance with the laws applicable in your jurisdiction.

• You have the legal capacity to enter into a binding agreement.

• All registration information you provide is accurate, complete, and up to date.

• You will promptly update any information that becomes inaccurate or outdated.

• Your use of the Platform complies with all applicable laws, regulations, and professional obligations.

We reserve the right to verify your eligibility and suspend or terminate accounts that do not satisfy these requirements.

3. Nutritionist Account Registration

To access Nutritionist Services, you must create and maintain a Nutritionist Account.

When registering, you agree to:

• Provide accurate and complete personal and professional information.

• Maintain only one Nutritionist Account unless otherwise authorized.

• Keep your contact information current.

• Register only information that you are legally authorized to provide.

• Cooperate with reasonable verification requests.

You may not:

• Register using false or misleading information.

• Impersonate another nutritionist or healthcare professional.

• Misrepresent your qualifications or professional experience.

• Create accounts on behalf of another individual without authorization.

We reserve the right to reject or remove registrations that violate these Terms.

4. Account Security

You are solely responsible for maintaining the security of your Nutritionist Account.

You agree to:

• Protect your login credentials.

• Maintain the confidentiality of your authentication information.

• Prevent unauthorized access to your account.

• Notify us immediately if you become aware of any unauthorized access or security incident.

• Log out of shared or public devices after use.

You remain responsible for all activities performed through your Nutritionist Account unless otherwise required by applicable law.

5. Professional Verification

To maintain the integrity of the Platform, we may request verification of your professional identity or qualifications.

Verification may include, but is not limited to:

• Identity verification.

• Professional qualification verification.

• License or certification verification where applicable.

• Contact verification.

• Additional documentation reasonably required for verification purposes.

Verification by the Platform does not constitute governmental licensing, professional accreditation, certification, endorsement, or recommendation.

We reserve the right to approve, reject, suspend, revoke, or repeat verification at our sole discretion where permitted by law.

6. Subscription Plans

Certain Nutritionist features may require an active paid subscription.

Subscription plans may determine access to features including, but not limited to:

• Client management.

• Meal plans.

• Recipes.

• Progress tracking.

• Daily tracking.

• Booking management.

• Offers.

• Notes.

• Client communication.

• Other premium functionality.

Subscription features, pricing, usage limits, and availability may change from time to time.

You are responsible for selecting the subscription plan that best meets your professional needs.

7. Payments

If your Nutritionist Account requires payment for subscription services, you agree that:

• All payment information provided is accurate.

• You are authorized to use the selected payment method.

• Subscription fees must be paid when due.

• Applicable taxes and processing fees remain your responsibility unless otherwise stated.

• Failure to complete required payments may result in restricted access, suspension, or termination of premium Services.

Unless otherwise specified, subscription fees are non-refundable.

8. Nutritionist Profile

Your Nutritionist Profile represents your professional presence within the Platform.

You are responsible for ensuring that all published information is accurate, complete, and kept up to date.

Your profile may include:

• Full name.

• Professional title.

• Biography.

• Profile photo.

• Cover image.

• Qualifications.

• Certifications.

• Areas of expertise.

• Contact information.

• Services offered.

• Working hours.

• Offers.

• Gallery images.

• Other professional information supported by the Platform.

You agree not to publish false, misleading, deceptive, unlawful, or infringing information.

We reserve the right to remove or modify profile content that violates these Terms or applicable law.

9. Professional Qualifications

You acknowledge that you are solely responsible for all qualifications, certifications, licenses, education, experience, and professional information displayed on your Nutritionist Profile.

You agree that:

• All qualifications presented are truthful.

• Professional claims are accurate.

• Expired or invalid qualifications will be promptly removed or updated.

• You will not falsely claim certifications, affiliations, awards, or licenses that you do not possess.

The Platform does not independently guarantee or validate every qualification displayed by Nutritionists.

10. Professional Conduct

As a Nutritionist using the Platform, you agree to conduct yourself professionally at all times.

You agree to:

• Treat clients respectfully.

• Communicate professionally.

• Respect client privacy.

• Maintain professional integrity.

• Provide services honestly and in good faith.

• Avoid deceptive, abusive, or unethical conduct.

• Comply with applicable professional standards and legal obligations.

You acknowledge that your professional reputation remains your own responsibility.

11. Professional Responsibilities

As a Nutritionist Account, you agree to use the Platform responsibly, ethically, and in compliance with all applicable laws.

You agree that you will:

• Provide accurate professional information.

• Maintain truthful client records.

• Manage client information responsibly.

• Respect client confidentiality.

• Publish accurate descriptions of your services.

• Maintain professional communication.

• Use the Platform only for legitimate professional purposes.

• Comply with these Terms, the Privacy Policy, the Health Disclaimer, and the Community Guidelines.

• Cooperate with reasonable verification, compliance, or security requests when necessary.

You further agree that you will not:

• Misrepresent your qualifications or experience.

• Create fictitious client records.

• Abuse administrative privileges.

• Attempt to bypass subscription limits or Platform restrictions.

• Manipulate reviews or ratings.

• Publish misleading offers or promotions.

• Use the Platform for unlawful, deceptive, or fraudulent purposes.

• Interfere with the operation, security, or integrity of the Platform.

• Encourage or assist others in violating these Terms.

Failure to comply with these responsibilities may result in warnings, feature restrictions, suspension, permanent account termination, or any other enforcement action permitted under these Terms.

12. Client Management

The Platform enables Nutritionist Accounts to manage clients through various professional tools and services.

As a Nutritionist, you acknowledge and agree that you are solely responsible for:

• Creating and maintaining accurate client records.

• Managing client relationships.

• Updating client information when necessary.

• Removing client records where appropriate.

• Using client information only for legitimate professional purposes.

• Complying with all applicable privacy and data protection laws.

You agree not to create false, duplicate, misleading, or fraudulent client records.

13. Client Information

You are responsible for ensuring that all client information entered into the Platform is collected, processed, and maintained lawfully.

You agree that:

• Information entered into the Platform is accurate to the best of your knowledge.

• You have a lawful basis to process client information where required by applicable law.

• Client information will be used solely for providing professional services through the Platform.

• You will not disclose, sell, distribute, or misuse client information without proper authorization or legal justification.

• You will respect client privacy and confidentiality at all times.

The Platform may restrict access to certain information where necessary to protect user privacy or comply with legal obligations.

14. Meal Plans

The Platform allows Nutritionist Accounts to create, manage, edit, publish, and assign meal plans.

You acknowledge that:

• You are solely responsible for all meal plans you create.

• Meal plans should accurately reflect your intended nutritional recommendations.

• You are responsible for reviewing and maintaining the accuracy of your meal plans.

• Clients remain responsible for deciding whether to follow any meal plan.

The Platform does not review, approve, certify, or guarantee the accuracy or effectiveness of meal plans created by Nutritionists.

15. Recipes

The Platform enables Nutritionists to create and publish recipes.

You are responsible for:

• Recipe titles.

• Ingredients.

• Preparation instructions.

• Nutritional information.

• Serving sizes.

• Images.

• Files.

• Any additional content associated with recipes.

You agree not to publish misleading, false, unlawful, or infringing recipe content.

16. Progress Tracking

The Platform provides tools to monitor and review client progress.

These tools may include:

• Progress history.

• Measurements.

• Weight records.

• Activity logs.

• Nutrition logs.

• Progress charts.

• Other tracking information supported by the Platform.

You acknowledge that:

• Tracking information depends on information entered by users.

• The Platform does not guarantee the accuracy or completeness of tracking data.

• You remain responsible for your professional interpretation of available information.

17. Daily Tracking

Clients may submit daily tracking information through the Platform.

You acknowledge that:

• Daily tracking data is self-reported unless otherwise indicated.

• The Platform does not independently verify submitted information.

• You are responsible for determining how to use such information within your professional practice.

18. Professional Notes

The Platform may allow you to create professional notes regarding your clients.

You agree that:

• Notes will be used only for legitimate professional purposes.

• Notes will be accurate to the best of your knowledge.

• Notes will not contain unlawful, discriminatory, defamatory, or inappropriate content.

• You remain solely responsible for all notes created through your account.

19. Booking Services

The Platform may provide appointment scheduling and booking functionality.

As a Nutritionist, you are responsible for:

• Managing your availability.

• Confirming appointments.

• Updating schedules.

• Rescheduling appointments.

• Cancelling appointments when necessary.

• Communicating scheduling changes to clients.

The Platform does not guarantee appointment attendance or successful scheduling.

20. Offers and Promotions

Nutritionist Accounts may publish promotional offers through the Platform.

You are solely responsible for:

• Offer accuracy.

• Pricing.

• Availability.

• Eligibility requirements.

• Redemption conditions.

• Expiration dates.

• Compliance with applicable advertising and consumer protection laws.

You agree not to publish deceptive, misleading, or fraudulent promotions.

21. Reviews and Ratings

Clients may submit reviews and ratings regarding your services.

You agree that you will not:

• Manipulate ratings.

• Purchase reviews.

• Create fake reviews.

• Encourage dishonest reviews.

• Pressure clients to leave positive feedback.

• Retaliate against clients for submitting honest reviews.

We reserve the right to investigate suspicious review activity and take appropriate action where necessary.

22. Communications

The Platform provides communication tools that may include:

• Direct messaging.

• Client notifications.

• Appointment notifications.

• Service updates.

• Meal plan notifications.

• Promotional communications.

• Booking updates.

• Other communication tools supported by the Platform.

You agree that communications sent through the Platform will:

• Comply with applicable laws.

• Respect client privacy.

• Not contain spam.

• Not contain misleading or deceptive information.

• Not include malicious software or harmful links.

• Be relevant to the professional services you provide.

You are solely responsible for all communications distributed through your Nutritionist Account.

23. Intellectual Property

The Platform, including but not limited to its software, design, layout, graphics, logos, trademarks, service marks, icons, databases, source code, features, functionality, text, audiovisual content, documentation, and all related materials, is owned by or licensed to the Company and is protected under applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not:

• Copy or reproduce any part of the Platform.

• Modify or create derivative works.

• Redistribute or republish Platform content.

• Sell, sublicense, lease, or commercially exploit the Platform.

• Remove copyright or proprietary notices.

• Use the Company's trademarks or branding without prior written authorization.

No ownership rights are transferred to you through your use of the Platform.

24. Nutritionist Content

You retain ownership of the content that you create and upload to your Nutritionist Account, including but not limited to:

• Professional profile information.

• Profile images.

• Certifications.

• Qualifications.

• Meal plans.

• Recipes.

• Nutrition guides.

• Educational materials.

• Client resources.

• Offers.

• Gallery images.

• Promotional materials.

• Notes.

• Files.

• Business information.

• Other professional content supported by the Platform.

By uploading or publishing such content, you grant the Company a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, process, display, reproduce, distribute, and make the content available solely for the purpose of operating, maintaining, improving, securing, promoting, and providing the Platform.

You represent and warrant that:

• You own the content or have all necessary rights to use and publish it.

• The content does not infringe any intellectual property or other legal rights of any third party.

• The content complies with applicable laws and these Terms.

25. Professional Representations

You acknowledge and agree that all information presented through your Nutritionist Profile is your sole responsibility.

This includes, but is not limited to:

• Professional qualifications.

• Certifications.

• Areas of expertise.

• Experience.

• Services offered.

• Working hours.

• Meal plans.

• Recipes.

• Educational content.

• Promotional materials.

• Prices.

• Booking availability.

• Professional descriptions.

You agree not to publish false, misleading, deceptive, or inaccurate professional information.

26. Limited License

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform solely for providing and managing your professional nutrition services.

This license does not permit you to:

• Copy the Platform.

• Resell access to the Platform.

• License the Platform to third parties.

• Reverse engineer or decompile the Platform except where permitted by applicable law.

• Develop competing services using the Platform.

• Access restricted systems.

• Circumvent subscription restrictions.

Violation of these Terms may result in immediate revocation of this license.

27. Prohibited Activities

As a Nutritionist Account, you agree not to:

• Violate any applicable law or regulation.

• Create fictitious client records.

• Misrepresent your qualifications or professional experience.

• Publish misleading nutritional information.

• Publish fraudulent offers or promotions.

• Manipulate reviews or ratings.

• Circumvent subscription limits.

• Share premium features with unauthorized users.

• Use another person's identity or credentials.

• Share confidential client information without authorization.

• Collect user information unlawfully.

• Use bots, scripts, crawlers, or automated systems without authorization.

• Reverse engineer the Platform except where legally permitted.

• Attempt unauthorized access to Company systems.

• Upload malware, ransomware, spyware, viruses, or other malicious software.

• Conduct phishing, fraud, or deceptive activities.

• Interfere with Platform operations.

• Overload Company infrastructure.

• Distribute spam.

• Sell or transfer your Nutritionist Account without written approval.

• Encourage or assist others in violating these Terms.

Violations may result in immediate enforcement action, including suspension or permanent termination.

28. Third-Party Services

The Platform may integrate with third-party services including, but not limited to:

• Payment providers.

• Authentication providers.

• Cloud infrastructure.

• Analytics providers.

• Mapping services.

• Push notification services.

• Customer support systems.

• Storage providers.

Your use of these services may also be governed by the terms and privacy policies of their respective providers.

The Company is not responsible for the availability, functionality, security, or performance of third-party services.

29. Third-Party Links

The Platform may contain links to external websites, applications, or services.

Such links are provided solely for your convenience.

The Company does not endorse or assume responsibility for any third-party content, products, services, security, or privacy practices.

Accessing third-party resources is entirely at your own risk.

30. Availability of Services

The Company strives to maintain reliable Platform availability but does not guarantee uninterrupted access.

Services may become unavailable due to:

• Scheduled maintenance.

• Emergency maintenance.

• Software updates.

• Security incidents.

• Infrastructure failures.

• Internet outages.

• Third-party provider failures.

• Events beyond our reasonable control.

The Company shall not be liable for temporary interruptions or delays in service availability.

31. Platform Modifications

The Company reserves the right to:

• Remove existing features.

• Modify subscription plans.

• Change usage limits.

• Improve functionality.

• Replace technologies.

• Introduce new professional tools.

• Retire obsolete functionality.

Such modifications may occur with or without prior notice where permitted by applicable law.

• Compatibility updates.

You acknowledge that:

• Certain updates may be mandatory for continued access to the Platform.

• Continued use of the Platform following updates constitutes acceptance of any applicable changes to the Services and these Terms.

33. Suspension of Services

We reserve the right, at our sole discretion and where permitted by applicable law, to temporarily suspend, restrict, or disable your Nutritionist Account or any portion of the Services if we reasonably determine that:

• You have violated these Terms.

• You have violated applicable laws or regulations.

• You have breached the Privacy Policy, Community Guidelines, or other applicable Platform policies.

• Your activities pose a security risk to the Platform or its users.

• Fraudulent, deceptive, or unauthorized activities are detected.

• Required subscription payments remain unpaid.

• Verification requirements are not satisfied or maintained.

• Your account is being used in a manner that could damage the integrity, stability, or reputation of the Platform.

Depending on the nature and severity of the violation, suspension may occur with or without prior notice where permitted by applicable law.

34. Account Termination

We may permanently terminate your Nutritionist Account if:

• You repeatedly violate these Terms.

• You engage in fraudulent or illegal activities.

• You intentionally misuse the Platform.

• You submit false or misleading professional information.

• You misrepresent your qualifications, certifications, or professional experience.

• You repeatedly violate subscription limitations.

• You abuse clients or other Platform users.

• We are legally required to terminate your account.

• You request permanent deletion of your account.

Upon termination:

• Your access to the Platform and related Services may immediately cease.

• Active subscriptions may be cancelled.

• Public professional information may no longer be visible.

• Certain information may be retained where required by law, for fraud prevention, security investigations, dispute resolution, auditing, or enforcement of our legal rights.

Termination does not relieve you of obligations incurred before termination.

35. Limitation of Liability

To the fullest extent permitted by applicable law, the Company, its owners, affiliates, directors, officers, employees, licensors, contractors, partners, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to:

• Your use of the Platform.

• Your inability to access or use the Platform.

• Client disputes.

• Professional services provided by you.

• Nutritional guidance or meal plans created by you.

• Recipes or educational materials published by you.

• Booking disputes.

• Loss of revenue, profits, business opportunities, clients, or goodwill.

• Unauthorized access to your account.

• Data loss.

• Service interruptions.

• Third-party service failures.

• Cybersecurity incidents beyond our reasonable control.

• Errors in Nutritionist-generated content.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

36. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, directors, officers, employees, licensors, contractors, partners, and service providers from and against any claims, liabilities, damages, judgments, penalties, losses, costs, or expenses (including reasonable legal fees) arising from or relating to:

• Your Nutritionist Account.

• Your professional services.

• Your interactions with clients.

• Your meal plans, recipes, notes, educational materials, or other published content.

• Your violation of these Terms.

• Your violation of applicable laws.

• Your infringement of any third-party rights.

• Client complaints or disputes arising from your professional activities conducted through the Platform.

37. Force Majeure

The Company shall not be liable for any delay, interruption, or failure to perform its obligations where such failure results from events beyond its reasonable control, including but not limited to:

• Natural disasters.

• Floods.

• Earthquakes.

• Fires.

• Epidemics or pandemics.

• War.

• Terrorist acts.

• Civil unrest.

• Government actions.

• Labor disputes.

• Internet outages.

• Power failures.

• Cloud infrastructure failures.

• Cyberattacks.

• Third-party service interruptions.

• Any other event beyond the reasonable control of the Company.

During such events, our obligations may be suspended for the duration of the event.

38. Governing Law

These Terms shall be governed by and interpreted in accordance with the applicable laws of the jurisdiction in which the Company operates, without regard to conflict of law principles.

39. Dispute Resolution

If any dispute arises concerning these Terms or your use of the Platform, the parties agree to first attempt to resolve the matter through good-faith negotiations.

If an amicable resolution cannot be reached, the dispute shall be submitted to the courts having competent jurisdiction under the applicable laws governing these Terms, unless mandatory law provides otherwise.

40. Severability

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, the remaining provisions shall remain valid, enforceable, and in full force and effect.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights available to the Company.

42. Entire Agreement

These Nutritionist Terms & Conditions, together with the Privacy Policy, Health Disclaimer, Community Guidelines, subscription terms, and any additional policies expressly incorporated by reference, constitute the entire agreement between the Company and the Nutritionist regarding the use of the Platform and supersede all prior agreements, communications, negotiations, and understandings relating to the Services.
